Mirick O’Connell regularly represents technology companies in corporate finance transactions, mergers and acquisitions, and securities and venture capital transactions.  We also negotiate and draft joint venture, licensing and development agreements for technology companies.  The firm represents technology companies in U.S. and international patent prosecutions and other forms of intellectual property protection.  Our litigators focus on enforcing and defending our clients’ intellectual property rights in court and before arbitration panels and administrative agencies.  Our intellectual property litigation experience includes cases involving technology patents, trademark/trade dress, trade secrets and related commercial disputes.

Representative Matters:

  • Represented a planar fuel cell technology company in its acquisition by a public company
  • Successfully negotiated subcontracts with a major defense contractor for a developer and manufacturer of miniature sensors in missile defense systems
  • Successfully prosecuted U.S. and foreign patent applications for anti-piracy software applications on behalf of a software company
  • Represented a technology company in connection with a $6 million venture capital financing
  • Obtained U.S. patent protection for a university for a computer network protocol
  • Successfully enforced a non-competition and non-solicitation agreement on behalf of a high-tech sales and distribution company against its former sales affiliate
  • Secured preliminary and permanent injunctions on behalf of a nano-particulate business against a former chief chemist for trade secret misappropriation
  • Obtained summary judgment in favor of an aerospace manufacturer in a race discrimination claim in the U.S. District Court for the District of Massachusetts; the plaintiff's appeal was dismissed by the U.S. Court of Appeals for the First Circuit
  • Successfully prosecuted patent applications for a company that develops fuel cell technology
